For the purposes of these Terms and Conditions (the “Terms”), the “Promoter” refers to TechnologyAdvice, LLC. The “Gift Card” refers to a five dollar ($5.00 USD) e-gift card to a limited selection of establishments preselected by the Promoter. The “Headset” refers to an Alienware Tri-Mode Wireless Gaming Headset AW920H (each individually a “Prize” and collectively the “Prizes”). By entering this competition (the “Competition”) you agree to be bound by these Terms. The Competition starts at 12:00 am on August 5, 2022, and all entries must be received by 11:59 pm on October 21, 2022. This Competition is open only to residents of the 50 U.S states and the District of Columbia, and participants must be 18 years of age or older. Employees of the Promoter, or its affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and their family members and persons living in the same households of such employees are not eligible to enter. All federal, state, and local laws and regulations apply. This Competition is void outside of the 50 U.S. states and the District of Columbia and where prohibited by law. By entering, winners certify that they meet all eligibility requirements. Each participant may be required to furnish proof of identification and other proof of eligibility under these Terms. No purchase is necessary, and a purchase will not increase your chances of winning. Winners will not be required to pay to enter the Competition.
Each participant shall enter the Competition by completing the Cyber Resiliency Assessment (the “Assessment”) being promoted by the Promoter. Promoter will be awarding up to five hundred (500) Gift Cards for the first five hundred (500) participants who complete the assessment. The participant shall receive an email with instructions on claiming the Gift Card within five (5) business days from the completion of the Assessment. If a participant completes the Assessment with a 100% score, they will also be entered into a monthly raffle for a Headset. Up to three (3) Headsets will be awarded to up to three (3) randomly selected, respective winners who have completed the assessment with a 100% score. The winner will be selected using a random number generator. A winner of a Headset will be selected on the last day of each month in which the campaign is live (one Headset winner will be selected at the end of August, one Headset winner will be selected at the end of September, and one Headset winner will be selected at the end of October; provided there are enough participants who complete the assessment with a 100% score) and the winner(s) will be notified on or after those respective dates. Only one entry per participant will be accepted.
The Promoter will not be held liable if any named Prize becomes unavailable or cannot be fulfilled. The Promoter will not be held liable for any failure of receipt of entries. The Promoter takes no responsibility for any entries which are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid. To the extent permitted by applicable law, the Promoter’s liability under or in connection with the Competition or these Terms shall be limited to the cost price of the Prize in question. To the extent permitted by applicable law, the Promoter shall not be liable under or in connection with these Terms, the Competition or any Prize for any indirect, special or consequential cost, expense, loss or damage suffered by a participant even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the participant and the promoter and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise. Prizes must be claimed within thirty (30) days (1) after the receipt of the Gift Card email in the case of a Gift Card, or (2) after the notification of winning a Headset in the case of a Headset, or the Prize shall be forfeited, subject to the Company’s sole discretion. Prizes are non-negotiable, non-transferable and non-refundable. No cash alternative is available. Where a Prize becomes unavailable for any reason, the promoter reserves the right to substitute that prize for a prize of equal or higher value. The name, address, email address and phone number of the winner must be provided to the Promoter if requested and will be shared to enable fulfillment of the Prize. In the event of unforeseen circumstances beyond the Promoter’s reasonable control, the promoter reserves the right to cancel, terminate, modify or suspend the Competition or these Terms, either in whole or in part, with or without notice. The Promoter’s decision is final. No correspondence will be entered into.
